Terms and Conditions

The following General Terms and Conditions apply to participation in events organised by PureDriving Motorsport + Events GmbH (hereinafter referred to as ‘PureDriving’).

Registration for an event is binding. The participation contract comes into effect upon written confirmation by PureDriving. A separate declaration of acceptance is not required. Confirmation of participation is usually sent by email.

The registrant is the person who submits the registration form and transfers the participation fee. This may also be the same person as the participant.

The participation fee must be paid in full immediately upon receipt of the invoice and no later than the date specified therein. In the event of late payment, PureDriving reserves the right to charge interest on arrears at the statutory rate and reminder fees.

3.1 The booked appointment is binding.

3.2 The registrant may name a suitable replacement participant, provided that this person meets the participation requirements. Any additional costs incurred as a result shall be borne by the registrant.

3.3 Persons aged 18 and over with a valid driving licence and no driving ban are eligible to participate. This must be presented on site. Without proof, the right to participate is forfeited, but the payment obligation remains.

3.4 The obligation to pay remains even in the event of non-participation. The provisions on withdrawal (Section 8) remain unaffected by this.

The services include:
– Conducting the training (theory and practice)
– Use of the vehicles provided
– Optional: meals and accommodation, if included in the respective tender

5.1 For training sessions with provided vehicles, an event-specific excess applies in the event of damage. The exact amount and any deposit regulations will be announced in the respective participation form or in the event description. Unless otherwise agreed, the excess is EUR 7,500 per claim.

5.2 PureDriving reserves the right to request a security deposit in the form of a cash deposit or credit card authorisation before the start of the event. The amount is specified in the respective event description.

5.3 Insurance cover shall not apply in the event of intentional or grossly negligent behaviour or failure to comply with safety instructions (e.g. exceeding the training speed, leaving the track, failing to follow the trainer’s instructions). Insurance cover applies exclusively to the active driving part of the event – arrival and departure are excluded.

5.4 In the event of a technical defect, PureDriving will endeavour to provide a replacement vehicle where possible. There is no entitlement to this.

6.1 Participation is at your own risk.

6.2 PureDriving shall only be liable for damages in cases of gross negligence or intent. In cases of simple negligence, liability shall only apply in the event of a breach of essential contractual obligations and shall be limited to foreseeable damages typical for this type of contract. This does not include damages resulting from injury to life, limb or health.

6.3 The personal liability of legal representatives, vicarious agents or partners of PureDriving is excluded. The same applies to landowners or third parties. Strict liability is excluded.

7.1 The instructions of the PureDriving team are binding. Overtaking is prohibited unless otherwise permitted by the trainer.

7.2 There is a strict ban on alcohol (0.0 per cent) during training. Participants who violate this rule may be excluded from further participation. In this case, there is no entitlement to a refund.

7.3 Accompanying persons participate at their own risk. They may only remain in the designated areas and may not participate in exercises. Liability for unauthorised accompanying persons is excluded.

8.1 The registrant may withdraw from the contract at any time. Cancellation must be made in writing. The date of receipt by PureDriving shall be decisive.

The following cancellation conditions apply:

– Up to 45 days before the start of the event: 10% processing fee

– 44 to 30 days: 50% refund

– 29 to 10 days: 20% refund

– From 9 days prior to arrival and in case of no-show: no refund

A suitable replacement participant may be nominated free of charge.

8.2 The registrant shall be free to prove that no damage or less damage has been incurred.

PureDriving may cancel the event for economic or organisational reasons up to 7 days before it begins. In cases of force majeure, cancellation may occur at short notice. Any participation fees already paid will be refunded in full. Further claims are excluded.

Austrian law applies exclusively. The place of jurisdiction is Graz, provided that the participant is an entrepreneur or does not have a place of residence in Austria.

For the purpose of handling the event, we store: billing information (10 years), email address and telephone number. This data will not be passed on to third parties and will only be used for the organisation of the event. Consent to the storage of data can be revoked at any time.

Photographs, film and sound recordings made during the event may be used for documentation and promotional purposes (e.g. website, social media). You may object to this use at any time.
